For our services , users are required to provide certain information for the registration
process namely your name, email address, sex, age, PIN code , sexual orientation,
password etc., and / or your occupation, interests, and the like.. The Information
as supplied by the users enables us to improve our sites and provide you the most
user-friendly experience.
All required information is service dependent and Soham Selection may use the above
said User information to, maintain, protect, and improve its services (including
advertising services) and for developing new services.
Such information will not be considered as sensitive if it is freely available and
accessible in the public domain or is furnished under the Right to Information Act,
2005 or any other law for the time being in force.

The Member or any users using the Site agree these Terms of Use ("Agreement").
RETURN & CANCELLATION POLICY
This policy governs the cancellation and return of any Order placed by the App/Website
User (defined hereinafter) on www.sohamselection.com (defined hereinafter) or the
Android or the iOS app.

2.ShamSelection, “Website / App User" or “User” or “he/ she” or “his/ her” shall
mean any natural or legal person who is competent to enter into a legally binding
Contract under the “Indian Contract Act, 1872” (hereinafter referred to as the “Contract
Act”). Any person who is not competent under the Contract Act to enter into a legally
binding Contract including minors, un-discharged insolvents, persons of unsound
mind etc. are not eligible to use this App/ Website. This App/ Website is intended
for individuals who are 18 years of age or above. By accessing or using this App/
Website or the services rendered by this App/ Website in any manner, the App/ Website
User warrants that he/ she is 18 years of age or above.
3. By accessing, browsing, using and/or availing the services, products and tools
provided by this App/ Website, the App/ Website User agrees to abide and be bound
by the provisions of this “Return and Cancellation Policy” as applicable to this
App/ Website. The App/ Website User’s access to and use of this Site and/or the
Services is conditional upon the App/ Website User’s acceptance and continuous compliance
with the provisions of this “Return and Cancellation Policy” and the Terms of Use
and other policies available on this Site at all times. The App/ Website Owner reserves
the right to refuse access to this App/ Website and/or terminate account(s) and/or
remove and/or edit content at any time without Notice to the App/ Website User.
It is the App/ Website User’s responsibility to review this “Return and Cancellation
Policy” periodically for updates/ changes. The App/ Website User’s continued use
of this App/ Website following the posting of changes will mean that he/she accepts
and agrees to the revisions. If the App/ Website User does not agree to be bound
by any of the provisions of this Return and Cancellation Policy then he/ she shall
not use and/ or access this App/ Website.
4. The App/ Website Owner owes no liability to the App/ Website User for citing
any reason for cancelling any Order made by the App/ Website User.
5. By mere use of this App/ Website, the App/ Website User expressly consents to
the terms of this “Return and Cancellation Policy”. This “Return and Cancellation
Policy” is incorporated into and subject to the Terms of Use of this App/ Website.
This “Return and Cancellation Policy” shall be read in accordance with and subject
to the provisions of the Terms of Use of this App/ Website.
6. The App/ Website Owner’s decision shall be final to decide whether the cancellation
and / or return request of the App/ Website User is accepted or not.
7.1. In case of product(s) ordered under this category, cancellation of the Order
is allowed only till the product(s) has not left the warehouse of the App/ Website
Owner.
8.2. The App/ Website User is advised to check the product(s) thoroughly at the
time of delivery and in case of any problem, including but not limited to, size,
colour, style and/ or damage, the App/ Website User shall intimate the Delivery
Personnel about the same and shall return the product(s) with the Delivery Personnel.
The Delivery Personnel will wait at the App/ Website User’s address for 15 minutes
from the time of delivery for the App/ Website User to try the product(s) and return
the same in case of any problem with the same.
8.3. Once, the Delivery Personnel leaves the premises of the App/ Website User and
till the product(s) reaches the warehouse of the App/ Website Owner, any kind of
damage found on the product(s) shall be the sole liability of the App/ Website User.
8.4. In case the App/ Website User fails to return the product(s) on the return
date, a per day late fee of 5% of MRP of the product will be charged up to a maximum
of MRP of product.
8.5. The above late fee shall be payable by the App/ Website User in the same manner
as the App/ Website User has paid for the Total Price of the product(s) while placing
the Order.
8.1. If the Site User has to return any product(s) upon its receipt, which is ordered
from this category, he and/ or she shall place the return request within 12 hours
from the time of delivery by sending an email to sohamselection007@gmail.com
8.2. No refund shall be made by the App/Website Owner if the return request is made
by the App/Website User after 12 hours from the time of delivery.
8.3. In case the App/Website User fails to return the product(s) on the return date,
a per day late fee of 5% of MRP of the product will be charged up to a maximum of
the Security Deposit deposited by him/ her.
9. In case of cancellation and/ or return of any Order being placed by the App/Website
User, the refund(s) to be made by the App/Website Owner to the App/Website User
of the Security Deposit and/ or Rental Fee and/or Delivery Charge and/ or any other
charge(s) would be refunded within 15- 45 days from the date of cancellation and/
or the return, depending upon the Bank Policies of the App/Website Owner and the
App/Website User, respectively.
10. All the refunds to be made are done through the Third Party Payment Gateways
engaged by the App/Website Owner. However, the App/Website Owner shall not be liable
in any manner, if there is any delay/ failure in the processing of the refund to
be made to the App/Website User, instead it is the liability and responsibility
of the Third Party Payment Gateways. It is hereby stated that the App/Website Owner
will take reasonable steps to get the refunds processed in a timely manner, but,
it cannot guarantee the same.
11. The App/Website User shall return the Sohamselection Zip Bag, Wooden Hanger,
Jewellery Box (if any) along with any other merchandise which was delivered with
the product(s). Failing which, INR 150/- shall be deducted from the Security Deposit
(if the product(s) delivered is ordered from the Sohamselection) and/ or INR 150/-
shall be paid by the Site User to the Delivery Personnel who comes to pick-up the
product(s), if the product(s) delivered is ordered from the Sohamselection.
12. The App/Website Owner will inspect the product(s) returned by the App/Website
User when it reaches its warehouse and check whether the product(s) is intact and
is in the same condition as it was when it was delivered to him/ her. Sohamseleciton
reserves the right to take the final decision about the condition of the returned
product(s).
13. In case of any Major Damage (any kind of loss which diminishes the commercial
value of the product, including but not limited to, theft, alteration, non-reversible
treatment to the fabric, replacing original product with fake product, fabric burn,
ripping off of the fabric) being caused to the product(s) while it is in the custody
of the App/Website User, an additional charge of up to 100% of the Retail value
of such product(s), as determined by the App/Website Owner, shall be payable by
the App/Website User.
14. The App/Website User explicitly agrees to the levy of such additional charge
on account of Major Loss (defined above) being caused to the product(s) while in
the custody of the App/Website User, as determined by the App/Website Owner.
15. In the event of Major Loss (defined above) being caused to the product(s) being
ordered from the Sohamselection, the additional charge, as determined by the App/Website
Owner, shall be payable by the App/Website User in the same manner as the App/Website
User has paid for the Total Price of the product(s) while placing the Order.
16. In the event of Major Loss (defined above) being caused to the product(s) being
ordered from the Sohamselection, the additional charge, as determined by the App/Website
Owner, shall be adjusted from the Security Deposit being paid by the App/Website
User and in case of the additional charge being higher than the Security Deposit,
the App/Website Owner is explicitly authorised by the App/Website User to levy the
balance of such additional charge, the balance of the additional charge shall be
payable by the App/Website User in the same manner as the App/Website User has paid
for the Total Price of the product(s) while placing the Order.
17. The App/Website User is advised to check the product(s) thoroughly at the time
of delivery and in case of any problem, including but not limited to, size, colour,
style and/ or damage, the App/Website User shall intimate the Delivery Personnel
about the same and shall return the product(s) with the Delivery Personnel. Once,
the Delivery Personnel leaves the premises of the App/Website User and till the
product(s) reaches the warehouse of the App/Website Owner, any kind of damage found
on the product(s) shall be the sole liability of the App/Website User.
18. The Pick-up time shall be mutually decided between the Delivery Personnel and
App/Website User over phone-call on the day of pick-up. The Delivery Personnel shall
call the App/Website User for knowing the Pick-up time.
19. It is hereby clarified that the App/Website Owner will take best efforts to
ensure that the product(s) ordered by the App/Website User under any of the categories
mentioned on this App/Website are delivered within the timelines specified in the
Terms of Use of this App/Website, however, in case of delay of more than 1 (one)
day from the specified delivery date and/ or time, the App/Website Owner shall refund
the entire amount charged for the product(s) ordered by the App/Website User from
this App/Website.

PAYMENT POLICY
The refundable deposit, if any, has to be paid in full while accepting the delivery
for the placed order. The affiliates of Sohamselection completing the delivery will
hand over a proforma invoice with the payment details chosen by the customer. The
invoice / receipt would be mailed to you electronically on successful completion
of the order.
There are no charges for delivery and pick-up, However Sohamselection may start
charging for the extra service at any point in future. The deposit, if any, is a
refundable & interest free amount, billed to you at the time of delivery or at the
time of confirming the order online and will be subject to refund only post successful
verification of the quality of the apparel returned to Sohamselection.
The deposit, partially or in full, may be retained if the apparel is damaged beyond
repair i.e. can’t be repaired or the cost of repairs being very high.
DELIVERY POLICY
Lessee has to be present at the agreed date and time at the specified address given
while placing an order with Sohamselection.
Accepted apparel/accessory cannot be returned without the fee being charged for.
Once you have accepted the delivery, no request on refunds, alterations, exchanges
may be entertained, however the decision of Sohamselection would be considered final.
Though we do quality checks at our end before delivery, the lessee is expected to
see if there are any damages and report the same to representative of lessor so
that an exchange may be arranged. Sohamselection does not guarantee that the same apparel/accessory
would be made available for exchange.
One signed copy of the pro-forma invoice is to be kept by each party.
PICK-UP POLICY
At the time of delivery, the apparel/accessory would be collected in the containers
provided by Sohamselection and will not be checked until they reach the warehouse of the
company. In case of damages, the company will inform you of the damages and would
take specific actions on retaining the deposit, an invoice will be given to you
for the same.
DAMAGE POLICY
The Lessee agrees to pay for any damage to, loss of, or any theft (disappearance)
of apparel/accessory , regardless of cause or fault.
Minor wear and tear is accepted and will be ignored, on consideration and acceptance
by Sohamselection.
Any damage that results in the product being unusable will result in the deposit
amount being charged to the lessee.
Stains on apparel/accessory which are not removable via dry cleaning / cleaning
will result in deposit amount being charged to the lessee. The extent of damage
would be ascertained by comparing against the apparel as was delivered to you by
Sohamselection. Any variation showing damages, if ascertained as not caused by normal wear
and tear, would result in the deposit being retained.
REFUND POLICY
If the apparel / accessory quality check is complete without any reports on wear
and tear and damage to the apparel, the whole amount of refundable deposit will
be refunded to the Lessee without any interest within 7 working days. It is clarified
that any cancellation of the Order(s) made by the App/Website User for any of the
product(s) shall be subject to the Return and Cancellation Policy. All the provisions
of the Return and Cancellation Policy shall govern any of the cancellation requests
made by the App/Website User in relation to any of the Order(s) placed by him/ her.
APPLICABLE LAWS AND JURISDICTION
Terms of Use and all other policies available on this App/Website shall be interpreted
and construed in accordance with the laws of India.
Any dispute or claim relating to products available on this App/Website or the services
rendered by this App/Website , its enforceability or the termination under these
Terms of Use and/ or other policies available on this App shall be governed by the
Arbitration and Conciliation Act, 1966 by a sole arbitrator, who shall be appointed
by the App/Website Owner. The place of Arbitration shall be Surat and the language
of proceedings shall be English. The App/Website User and the App/Website Owner
agree specifically to submit to the exclusive jurisdiction of the Courts of Surat, India over any disputes relating to the subject matter, herein.
Unless, otherwise specified, the products available and the services offered by
this App/Website are solely rendered in India. The App/Website Owner makes no representation
that the products on this App/Website are for use/ available in any other Country/
location other than India. The App/Website User may choose to access this App/Website
from any other location, other than India, but, he/ she does this in his/ her sole
discretion and the App/Website Owner shall not be responsible, in any manner, for
supply/ delivery of products ordered from locations, other than India.
